Entry guidelines for Kannelloni competitions

§ 1 General

Participation in a competition on the Facebook/Instagram page “Kannelloni” (https://www.facebook.com/KanneloniHeede26892/| https://www.instagram.com/kannelloni_heede/) – hereinafter referred to as “the organizer” – is only possible subject to these conditions of participation. The competition is not supported by Facebook / Instagram and is not affiliated with Facebook / Instagram.

§ 2 Participation requirements

All natural and legally competent persons with a minimum age of 18 years can participate. Employees of the organizer and their relatives are excluded from participation. By participating, the participant agrees to his/her name and/or picture being published on the Internet in the event of winning. Participation is only possible within the period specified in the competition description. Legal recourse is excluded.

§ 3 Profit

The prize will be awarded as advertised in the competition. The winner will be drawn by lot, with no legal recourse. A change or cash payment of the prize is excluded. The winner will be notified by the organizer via Facebook or as described in the competition. If the winner does not respond to the prize notification within the deadline we set, the prize will be forfeited without substitution. In the case of the Advent calendar competition, the respective prize must be collected/redeemed in the relevant establishment by 31.01. of the following year at the latest.

§ 4 Liability

Claims for damages against the organizer in connection with the competition are excluded – to the extent permitted by law – regardless of the legal grounds, unless the organizer has intentionally or grossly negligently violated legal obligations. Furthermore, the organizer is not liable for damages resulting from the impairment of the availability of the competition website in the event of technical faults and force majeure events beyond its control, as well as attacks by third parties against the competition website. However, the organizer will make every effort to ensure the reliability and functionality of the competition website. Furthermore, the organizer does not guarantee that the competition website will function properly on the respective participant’s computer.

§ 5 Data protection

The organizer guarantees the highest possible standard of data protection in the context of the competition and observes all relevant legal provisions in this regard. The organizer will not pass on any personal data to third parties or sell address data. The organizer will store the personal data of the respective participant solely for the purpose of the competition. The participant hereby expressly declares his/her consent to the storage and use of the personal data provided for the above-mentioned purpose.

§ 6 Place of jurisdiction / applicable law

In the event of disputes, German law shall apply exclusively. To the extent permitted by law, the place of jurisdiction shall be the registered office of the organizer. If the participant has no general place of jurisdiction in Germany or moves his/her place of residence abroad after participation, the organizer’s registered office is also agreed as the place of jurisdiction.

§ 7 Selection procedure

1.1 The winners will be selected using a random generator (http://www.fanpagekarma.com/facebook-promotion / https://commentpicker.com/business-instagram.php). Legal recourse is of course also excluded here.

§ 8 Severability clause

Should individual provisions of these conditions of participation be invalid or should there be a loophole, this shall not affect the validity of the remaining provisions. The invalid or missing provisions shall be replaced by a provision that comes closest to the purpose of the contract and the statutory provisions.
